Introduction

This Privacy Policy describes how OSS Recruitment Inc. (“OSS Recruitment,” “we,” “our,” or “us”) collects, uses, discloses, and protects personal information when you use the OpenSimSim™ recruitment platform (the “Platform”), which is operated by OSS Recruitment Inc., and any related services (collectively, the “Service”). It also describes your rights and choices regarding your personal information. Audience: This Privacy Policy is intended for individuals who use the Platform on behalf of an employer account (such as hiring managers, recruiters, or other employer representatives). By creating an employer account or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Platform. We may ask you to accept this Privacy Policy (and any updates) during account creation or in the course of using the Service. For purposes of data protection laws, OSS Recruitment Inc. is the “business” (under California law) or “data controller” (under other privacy laws, if applicable) responsible for the processing of personal information described in this Policy.

Information We Collect

We collect or receive various types of information in order to operate our Service and match employers with potential candidates. This includes information that you provide directly, information we obtain from third parties about job candidates, and information collected automatically about your use of the Platform.

Information You Provide to Us (Employer Account Data)

When you register for or use the Platform as an employer (account owner), you provide certain personal and business information. This may include:

  • Business and Contact Information: Name, job title/role, company name, business address, business phone number, and business email address. We may also collect business registration details like an Employer Identification Number (EIN) for verification and compliance.
  • Account Credentials: A username and password to log into the Platform (passwords are stored securely in hashed form and not visible in plaintext).
  • Billing Information: If you subscribe to a paid plan, payment information such as credit card number, billing address, and billing contact details (note: payment card data is handled by our PCI-compliant payment processor and generally not stored on our systems beyond minimal reference info).
  • Job Posting Details: Content of job postings you create (job titles, descriptions, qualifications, location, salary ranges, etc.). This may incidentally include personal information (for example, a hiring manager’s name or contact info if you include it in a job description).
  • Communications and Messaging: The content of communications you send through the Platform. For instance, messages or interview invitations to candidates, scheduling requests, feedback or notes about candidates, or any other information you share (e.g. responses to surveys or support inquiries).
  • Support and Feedback: Information you provide when contacting us for customer support or giving feedback. This can include your name, contact information, and the content of your correspondence.

We will only ask for information that is necessary for the intended purpose. You may choose not to provide certain optional information; however, doing so might limit your ability to use some features of the Service (for example, not providing required billing information would prevent subscribing to paid services).

Information from Third-Party Candidate Platforms (Candidate Data)

A key feature of our Service is sourcing and presenting candidate profiles from third-party candidate platforms (worker-facing platforms where individuals maintain profiles and availability for work). OSS Recruitment obtains candidate personal information from such third-party sources to facilitate job matching and communication. This may include:

  • Candidate Profile Data: The candidate’s name, contact information (phone number, email), location, work experience, skills, certifications, education, and any other information the candidate has provided in their profile or résumé on the third-party platform.
  • Availability and Preferences: Information about the candidate’s availability for work (e.g. preferred schedules or hours) and job or location preferences, which help match them to your job postings.
  • Ratings or Work History: If the third-party platform tracks past job performance, reviews from previous employers, work history (e.g. hours worked or tenure), or similar metrics, some of that data might be shared with our Platform to inform matching.
  • Other Candidate Data: Any other relevant details authorized by the third-party platform and the candidate, potentially including background check status or work eligibility, if such data is collected and permitted to be shared.

Important: The candidate data we import from third-party platforms is originally collected under those platforms’ privacy practices and with the candidates’ consent for use in job matching. We process this candidate information solely to enable you to view and evaluate candidates for potential employment through our Platform. We do not use candidate data for purposes outside of the recruitment process on our Platform (for example, we do not repurpose candidate information for unrelated marketing). Your use of candidate personal information obtained through our Service is governed by our Terms & Conditions and applicable law. You are required to treat such candidate data as confidential and use it only for legitimate hiring evaluation and communication via the Platform, unless and until you hire the candidate (at which point you would handle their data under your own employee privacy policies).

Information Collected Automatically

When you use the Platform (via web or mobile app), we and our third-party service providers automatically collect certain technical and usage information about your visit. This can include:

  • Device and Browser Data: Information about the device and browser you use, such as device type, operating system name and version, browser type and version, and device identifiers. For mobile app users, this might include a mobile device ID; for web users, it could include your browser’s user agent string.
  • Log and Usage Data: Server logs record details about your use of the Service, including your Internet Protocol (IP) address, login timestamps, pages or screens viewed, actions taken (e.g. searches performed, jobs posted, candidates viewed), and the webpage or app you visited before coming to our Platform.
  • Cookies and Similar Technologies: We use cookies, pixels, and similar tracking technologies to collect data about your interactions with the Service. For example, cookies may store your session information to keep you logged in, remember your preferences, or track your navigation for analytics. Some cookies or tags are placed by third-party analytics or advertising partners (see Cookies and Tracking below for more details). This automatically collected data helps ensure the Platform functions properly, allows us to improve the Service, and provides you with a more personalized experience.

We may combine the different types of information collected (for instance, linking your automatically collected data with your account profile) to better understand how you use the Service and to improve our features (such as enhancing matching algorithms and customer support).

How We Use Your Information

We use the collected information for the following purposes, all in support of providing and improving the recruitment Service for you:

  • Providing the Service: We use personal information to operate the Platform and deliver our services. This includes creating and maintaining your account, showing you relevant candidate matches for your job postings, facilitating communications between you and candidates, and enabling scheduling or other hiring-related processes. For example, information in a job post you create will be used to match it with candidate profiles from integrated talent sources, and we use your contact information to send you notifications (such as when new candidates match your posting or when you receive a message).
  • Processing Payments: We use your billing and payment details to process subscription fees or any applicable hiring commissions. Payment information is used to charge for the service via our secure payment processor and to manage billing, invoices, and receipts.
  • Communication: We use your contact information (email, phone) to send service-related communications. These include confirmations of actions you take, administrative messages, account or subscription updates, job posting or candidate match alerts, and other operational notices. We may also send you optional communications like newsletters, surveys, or promotions about new features or services — you can opt out of marketing emails if you prefer. (Please note that you cannot opt out of certain transactional or administrative emails necessary for the Service, such as billing notices or security alerts).
  • Customer Support: If you contact us with questions or issues, we will use the information you provide (including any contact details and the content of your inquiry) to respond and resolve your concerns. We also may use information about technical issues or errors you encounter to debug, troubleshoot, and improve the Platform.
  • Service Improvement and Analytics: We analyze usage data, feedback, and trends to improve the functionality and user experience of our Platform. For example, we might review how users interact with certain features to guide UX improvements, or analyze aggregate hiring outcomes to refine our candidate matching algorithms. Wherever possible, we use aggregated or de-identified data that does not personally identify individuals for analytics. If we use third-party analytics tools (such as Google Analytics or similar analytics platforms), those tools may collect and process data about your interactions on our behalf (see Cookies and Tracking below for more on analytics).
  • Security and Fraud Prevention: We use information (particularly technical and usage data) to monitor for and prevent fraudulent, unauthorized, or malicious activity on the Platform. This includes detecting and preventing security incidents, protecting against unauthorized access, and enforcing our Terms & Conditions. For instance, we may monitor IP addresses and login activity to identify suspicious logins, and we may scan content (like messages) for spam, malware, or policy violations.
  • Legal Compliance and Enforcement: We may process personal information as needed to comply with applicable laws and regulations, respond to lawful requests and legal processes, or enforce our agreements and policies. This includes using or preserving information as required for tax and accounting regulations, handling disputes, and responding to subpoenas or court orders.
  • Automated Processing and AI: We may use automated systems or artificial intelligence technologies to process data and support certain Platform features. For example, our matching algorithms or other recommendation features may use machine learning techniques to improve results. However, we do notrely on solely automated decision-making that produces legal or similarly significant effects without human involvement. Any AI or automated processing is intended to assist our services (e.g. suggesting candidate matches) and not to make final decisions without human review.

We will not use your personal information for purposes unrelated to the Service, nor in ways not disclosed in this Privacy Policy, without your consent.

Disclosure of Your Information

We share your information only in the circumstances described below, and only as necessary to provide our services or as permitted by law. We do not disclose your personal information to third parties for their own independent marketing purposes. The categories of parties with whom we may share data include:

  • Service Providers: We share personal information with third-party service providers and partners who perform services on our behalf and under our instructions. This includes, for example: cloud hosting providers (for data storage and infrastructure), payment processors (for billing transactions), analytics and tracking providers (to help us understand Platform usage), error monitoring services, email and SMS delivery providers, and customer support software tools. These service providers are contractually obligated to protect your information and to use it only for the purposes of providing services to us (not for their own purposes). Examples: We use analytics tools and tracking technologies such as Google Analytics and PostHog to analyze usage; error reporting services like Sentry to monitor and fix issues; communication services like Twilio to send SMS or phone notifications; and email services (including testing platforms such as Mailtrap for email delivery in non-production environments) to manage communications.
  • With Candidates: As part of the Platform’s recruiting functionality, some of your information will be shared with candidates when you engage in the hiring process. For instance, if you post a job opening, the content of the job post (including your company name and any details you choose to include in the post) will be visible to potential candidates. If you send a candidate a message or interview request through the Platform, the candidate will see your name (or the name of the company representative who sends the message) and any contact information you include in that communication. We limit what candidate users can see by default – for example, candidates can view your company profile and the job details you publish, but your internal notes or full contact details are not shared unless you explicitly provide that information to the candidate. Any feedback or personal notes you enter about candidates on the Platform (such as interview notes or ratings) are private to your company’s account and not visible to the candidate or other employers.
  • Third-Party Integrations: If you choose to integrate our Platform with a third-party service or software (for example, a scheduling or workforce management system, HR software, or other platform), we will share data with and receive data from that third party as necessary to enable the integration. This sharing only occurs at your direction when you connect the Platform to another service. For example, if you integrate with a scheduling system to seamlessly onboard a hired candidate, we might share an identifier for the candidate and their hiring status so the other system can update your records (such as tagging the new employee for scheduling or commission calculations). Similarly, we might receive scheduling or timesheet data from that integrated platform to display within our Service. Any third-party integration partner’s use of data will be governed by that third party’s own privacy policy, so we encourage you to review the terms and policies of any service you connect with our Platform.
  • Within Our Corporate Group: OSS Recruitment may share personal data with its affiliates, subsidiaries, or parent company (if any) as needed to operate and improve the Service. Any internal sharing is subject to confidentiality and those entities will honor the commitments of this Privacy Policy.
  • Legal Requirements and Safety: We may disclose personal information if we believe in good faith that such action is necessary to comply with a legal obligation or request (for example, to respond to subpoenas, court orders, or governmental requests), to enforce our Terms & Conditions or other agreements, or to protect the rights, property, or safety of OSS Recruitment, our users, candidates, or others. This includes exchanging information with other companies and organizations for fraud prevention or security protection. If we receive a lawful request for user data (e.g. a subpoena directed to OSS Recruitment regarding your account), we will attempt to redirect the requesting party to obtain the data directly from you or your company when appropriate, and we may notify you of such requests if legally permitted to do so.
  • Business Transfers: If OSS Recruitment is involved in a corporate transaction such as a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, or sale of company assets, or if the Service is transferred to another provider, your information may be transferred as part of that transaction. In such cases, we will ensure that the successor entity is bound by terms substantially consistent with this Privacy Policy, and we will notify you of any change in ownership or new uses of your personal information, as well as any choices you may have regarding your personal information in that event.

Other than the instances above, we will not share your personal information with third parties unless you direct or consent to it. For example, if in the future we offer a feature for you to publish testimonials or share content to social media through the Platform, we would only share your information in that way with your explicit consent.

Cookies and Tracking Technologies

Like most online services, our Platform uses cookies and similar tracking technologies to ensure functionality and to collect information about your use of the Service. What Are Cookies: Cookies are small data files placed on your browser or device. They can be “first-party” (set by us) or “third-party” (set by other companies), and they can be session cookies (temporary, deleted when you close your browser) or persistent cookies (remaining on your device for a set period or until you delete them). Technologies related to cookies include pixel tags (small images embedded on webpages or emails), local storage, and device identifiers; for simplicity, we refer to all of these as “cookies” here.How We Use Cookies: We use cookies and similar technologies for several purposes:

  • Necessary Cookies: These cookies are essential for the Platform’s operation. For example, they enable core functionalities like user authentication (keeping you logged in as you navigate) and security (preventing fraud or abuse). Without these cookies, the Service may not function properly.
  • Preferences Cookies: These cookies remember your preferences and settings to provide a more personalized experience. For instance, they might store your selected language or other customizations so you don’t have to set them every time.
  • Analytics Cookies: We use analytics cookies to understand how users use our Platform, which pages or features are most popular, how users navigate through the site, and other usage metrics. This helps us improve our Service over time. We may use third-party analytics services (for example, Google Analytics or similar tools) that set their own cookies or identifiers to collect information such as IP address, browser type, pages visited, and time spent on pages. We configure these tools to respect privacy (for instance, by enabling IP anonymization where available) and we generally view the data in aggregate form. The information collected via analytics cookies is used for statistical purposes and is not intended to identify you personally.
  • Advertising/Tracking Cookies: As of now, our employer Platform is primarily a B2B service and we do not heavily use advertising cookies. However, we may use certain tracking cookies or pixels (such as the Facebook Pixel or Google Ads tags) to measure the effectiveness of our own marketing campaigns or to reach people with relevant advertising if you opt in to such cookies. For example, if we run ads on other platforms, a tracking pixel could help us know if you signed up after clicking one of those ads, and could allow us to show follow-up ads to you or similar audiences. These advertising cookies would send some of your browsing information to the third-party (like Facebook or Google) to enable their advertising services. We will not activate advertising or social media tracking cookies unless you have provided consent via our cookie consent tool.

Cookie Consent & Control: When you first use our Platform, you will see a cookie notice or settings dialog that allows you to choose which categories of cookies to accept (aside from strictly necessary cookies, which are always used to provide the core service). You can opt in or out of optional cookies (like analytics or advertising cookies) using this tool. If you opt in and later change your mind, you can adjust your preferences at any time via the cookie settings on our site (if available) or by clearing cookies in your browser.Additionally, most web browsers provide settings to let you delete or refuse cookies. You can use your browser settings to manage cookies from our Service, though please note that blocking all cookies (especially essential ones) may impair certain functionalities. There are also industry-wide opt-out mechanisms for certain cookies – for example, Google offers a browser add-on to opt out of Google Analytics, and advertising networks provide opt-out options through sites like the Network Advertising Initiative or Digital Advertising Alliance.For more detailed information on the specific cookies and tracking technologies we use on the Platform, you may refer to our Cookie List (if available), which provides a list of cookies, their purposes, and their lifespans. We update this Cookie List periodically to reflect current usage.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In practice:

  • Employer Account Data: If you have an account with us, we retain the personal information associated with your account for as long as your account is active. If you close your account or your subscription ends, we may continue to retain your data for up to five (5) years from the date of last use or account closure. This retention allows us to comply with legal obligations (for example, maintaining payment records for tax or audit purposes, or retaining records in case of disputes) and to have information available in case you reactivate your account within a reasonable period. After that period, we will either delete your personal information or anonymize it (so it can no longer be associated with you), unless we are required by law to keep it longer.
  • Candidate Data: Personal information about candidates that is sourced from third-party platforms and presented to you is generally transient in our system – we display current data from the source at the time of matching. We regularly sync with the third-party platform to refresh candidate data; if a candidate’s profile is deleted on the source platform, we will stop displaying their information in our Platform. If you have engaged with a candidate through our Platform (for example, exchanged messages or made notes about the candidate), records of that interaction will be retained as part of your account history. For any candidate data that does get stored in our system (such as message logs or notes), we apply similar retention principles: such data may be kept for up to 5 years for record-keeping, unless you or the candidate request deletion earlier, subject to our rights and legal obligations.
  • Logs and Analytics: Server logs, audit logs, and analytics records are generally retained in identifiable form for a shorter period (typically around 1–2 years), though we may preserve aggregated, anonymized analytics data for longer to identify long-term usage trends. We keep these logs to monitor system security, debug issues, and analyze usage over time.
  • Legal Holds: If we are involved in a litigation, investigation, or receive a legal request (such as a subpoena), we may need to retain relevant data until the issue is resolved, even if it goes beyond our standard retention periods. Similarly, if a law or regulation requires us to keep certain data for a specified period (for example, certain financial, employment, or health and safety records), we will retain that information for the mandated duration.

After the applicable retention period has elapsed, we will securely delete or anonymize the personal information. When we anonymize data, we remove or alter identifying details so that the data can no longer be linked to any individual. We may use such anonymized data for legitimate business purposes, such as aggregate analytics, research, or product development, indefinitely without further notice to you (since anonymized data is no longer personal data).

Your Rights and Choices

You have certain rights and choices regarding your personal information. These rights may vary based on your jurisdiction (for example, California residents have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), and similar rights exist for individuals in the European Union under the General Data Protection Regulation (GDPR)). OSS Recruitment is committed to honoring applicable rights, which include:

  • Right to Access/Know: You have the right to request access to the personal information we hold about you and to receive information about how we use and share it. This includes the right to ask for a copy of the specific pieces of personal data we have collected about you, as well as details about the categories of personal information, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we have shared it.
  • Right to Rectification (Correction): You have the right to request that we correct or update any inaccurate or incomplete personal information we maintain about you. You can also correct certain information yourself by logging into your account settings (for example, you can update your contact details or other profile info directly).
  • Right to Deletion: You have the right to request deletion of your personal information, subject to certain exceptions provided by law. For example, we may need to retain some information to complete transactions you’ve initiated, to detect or prevent fraud, for security, to comply with legal obligations, or for other internal uses consistent with your expectations. If you request deletion, we will remove (or anonymize) the personal information that is not subject to an exception, and will instruct our service providers to do the same. Please note that if you request deletion of key data (such as information in your account), you may lose access to the Service or certain features, since the Service may no longer function without the deleted data.
  • Right to Opt-Out of Sale or Sharing: If you are a California resident, you have the right to direct us not to sell your personal information or share it for targeted or cross-context behavioral advertising purposes. We do not disclose personal information to third parties for their own marketing, but to exercise your opt-out rights under California law (for “Do Not Sell or Share”), you can contact us at any time to submit a request. We will honor and record your request in accordance with applicable laws. If our practices change in the future such that they involve “selling” or “sharing” personal information (as defined by California law), we will provide a clear method for you to opt out (such as a “Do Not Sell or Share My Personal Information” link on our website) and obtain any required consent.
  • Right to Limit Use of Sensitive Personal Information: California residents have the right to limit the use of “sensitive personal information” (as defined by law) if it is used for purposes beyond what is necessary to provide the Service. In general, we do not use sensitive personal information (e.g. government-issued IDs, financial account info, precise geolocation, etc.) for purposes outside of operating our Service or as otherwise required by law. If we ever request or plan to use sensitive information for additional purposes, we will provide appropriate opt-out or limit mechanisms as required.
  • Right to Data Portability: You may have the right to receive a copy of your personal information in a portable, commonly used electronic format, so that you can transmit it to another entity if you choose.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means, for example, we will not deny you the Service, provide a different level or quality of Service, or charge you a different price (outside of any legally permissible differences) because you exercised your rights.

Exercising Your Rights: To exercise the rights described above, please contact us by email or mail using the contact information in the Contact Us section at the end of this Policy. Please include “Privacy Request” in the subject or attention line and describe your request with sufficient detail so that we can understand and respond to it. We may need to verify your identity before fulfilling certain requests – for example, we might ask you to confirm information we already have on file or provide additional verification information – to ensure that we are handling your data (and not someone impersonating you). In some cases, you may designate an authorized agent to make a request on your behalf, but we will require proof of the agent’s authority and may still ask you to verify your identity directly.

  • California Residents: If you are a California resident making a privacy rights request (such as access or deletion), you can also call our toll-free number (if we make one available) or otherwise reach out viacontact us using the designated methods belowabove. We will confirm receipt of your request within 10 days (as required by law) and will endeavor to respond with the requested information or action within 45 days of receiving your request (if we need more time, we will inform you, and in any case will complete the request within 90 days as permitted by law). Please note that by law, we are only required to fulfill certain access requests twice per 12-month period per user.
  • Do Not Track Signals: Some web browsers offer a “Do Not Track” (DNT) setting that signals to websites that you do not want to be tracked. The Platform does not currently respond differently to web browser DNT signals. However, we provide various opt-out options for cookies and tracking (see the Cookies and Tracking section above), and we honor the Global Privacy Control (GPC) signal – if detected – as a valid opt-out of sale/sharing for California residents where applicable.

Corporate Accounts and Administrative Access

Important Note for Enterprise or Team Accounts: If you are using the Platform under a corporate or enterprise account (for example, your company has a master account and you are an authorized user under that account), please be aware of the following:

  • Access by Company Administrators: The administrator(s) of your company’s account on the Platform may have the ability to access all data within that account. This could include information about your usage of the Platform (e.g. jobs posted or candidates viewed) and the content of communications you send via the Platform. For instance, if you are one recruiter among several on your company’s account, a manager or admin user might be able to view the candidates you have engaged with, read messages or notes, or reassign candidates between team members. Your company’s internal policies will govern how company administrators or other team members are allowed to access or use information within your account.
  • Company Requests for Data: If your employer (the account owner) or an authorized authority within your company requests access to data held in the Platform (for example, for an internal audit, compliance check, or a legal matter), OSS Recruitment may provide the company with such data after verifying the legitimacy of the request. We will only share data with the company that the company is already entitled to as the account owner, or as required by law. In practice, this means your employer generally has rights to the data in the account since it is their account with our Service.
  • Individual Privacy Requests in a Corporate Context: If you are an individual user of our Platform under a corporate account and you submit a data rights request (such as an access or deletion request), we may inform the account owner (your employer) of your request. In some cases, we might require the employer’s approval before deleting or porting data that they may need to retain (for example, records of hires or financial transaction history). We will, however, communicate with you regarding the fulfillment of your request and make good faith efforts to honor individual rights while balancing the needs and rights of the corporate customer.
  • Legal Compliance for Corporate Accounts: If OSS Recruitment receives a subpoena, court order, or other legal process seeking data associated with a corporate account, we may be obligated to comply and provide the requested information. Where permissible and practical, we will attempt to notify the affected company (and individual, if appropriate) before disclosing data in response to such legal demands.

In summary, when your Platform account is part of a company’s enterprise account, that company (as our customer) generally has broad rights to access data associated with the account. Please use any company-provided Platform credentials appropriately and be mindful that communications or content you handle through the Platform may be visible to authorized personnel in your organization.

Security Measures

We take the security of your personal information seriously and implement reasonable technical and organizational measures to protect it from unauthorized access, loss, misuse, or alteration. These measures include, but are not limited to:

  • Encryption: Data is encrypted in transit (we enforce TLS/HTTPS for data transfer) and, where applicable, at rest on our systems.
  • Access Controls: We employ firewalls and access control mechanisms to restrict access to systems and databases that store personal data. Only authorized personnel with a need to know can access sensitive information.
  • Vulnerability Management: We conduct regular security audits, penetration testing, and monitoring of our systems to detect and address vulnerabilities or attacks in a timely manner.
  • Employee Training and Policies: Our employees receive training on data protection best practices, and we limit employee access to personal data on a need-to-know basis. Staff are bound by confidentiality obligations and face disciplinary measures if they fail to meet our privacy and security standards.
  • Secure Infrastructure: We use reputable cloud service providers and data center partners who employ strong physical and network security practices. Our systems are designed with redundancy and backup capabilities to protect data integrity and availability.

Please note that despite our efforts, no security measure or method of data transmission over the Internet is 100% guaranteed to be secure. Therefore, we cannot promise absolute security of your information. You can help protect your account by using a strong, unique password and keeping it confidential. If you believe that your account or information has been compromised or if you notice any suspicious activity, please notify us immediately at [email protected] so we can investigate and take appropriate action.

Children’s Privacy

Our Platform and services are not intended for use by minors. We do not knowingly collect personal information from anyone under the age of 18. If you are under 18, you should not use the Platform or provide any personal information to us. In the event we become aware that we have collected personal information from a child under 18, we will promptly delete that information from our records.
